Senate Blocks Digital Asset Market Clarity Act

The United States Senate voted 49 to 50 on Tuesday afternoon against taking up the Digital Asset Market Clarity Act, blocking the crypto market structure bill a day after Republicans released its final text, according to The Defiant. Cloture on the motion to proceed to H.R. 3633 fell 11 votes short of the 60 required under a unanimous consent agreement.

All 49 votes in favor of proceeding came from Republicans, with no Democrats or independents supporting the measure. Four Republican lawmakers, Susan Collins, Josh Hawley, Jerry Moran, and Thom Tillis, voted against the motion. Senator Chris Coons did not participate in the vote.

The House of Representatives had previously passed H.R. 3633 by a 294 to 134 margin in July 2025. The Senate version that failed to advance this week was introduced as an amendment in the nature of a substitute.

Senator Thom Tillis voted against the motion to preserve the procedural right to move for reconsideration, filing the motion immediately after the result was announced. The legislative maneuver keeps a second cloture vote on the table without requiring a fresh filing.

Following the Senate vote, prediction markets adjusted their outlook for the legislation. Data from Polymarket shows the probability of the bill becoming law this year dropped sharply from 29.5% to 6.5% following the procedural defeat. The Senate proceeded to other legislative business shortly after the roll call concluded.
